ADA Accommodation Policy
SW Security Training LLC ("SWST") is committed to providing equal access to its training programs, services, and activities in accordance with the Americans with Disabilities Act of 1990 (ADA), as amended, and all other applicable federal and Oregon laws.
SWST will provide reasonable accommodations to qualified individuals with disabilities when such accommodations enable meaningful participation in training programs and do not fundamentally alter the nature of the training, create an undue burden, compromise safety, or conflict with regulatory requirements established by the Oregon Department of Public Safety Standards and Training (DPSST) or other governing authorities.
1. Purpose
The purpose of this policy is to ensure that qualified students with disabilities have an equal opportunity to participate in SWST training programs while maintaining compliance with applicable laws, safety standards, licensing requirements, and course objectives.
2. Eligibility
A student seeking an accommodation must:

Have a disability recognized under applicable law.

Be otherwise qualified to participate in the course.

Meet all prerequisite licensing or enrollment requirements.

Be capable of safely participating in the training with or without reasonable accommodation.
3. Requesting an Accommodation
Students requesting an accommodation should notify SWST as early as possible, preferably at least fourteen (14) calendar days before the scheduled course date.
Requests should include:

The specific accommodation requested.

A description of the disability-related limitation.
-
Supporting documentation from a licensed healthcare provider when the disability or requested accommodation is not readily apparent.
Failure to provide advance notice may limit SWST's ability to implement accommodations before the start of training.
4. Interactive Process
Upon receiving a request, SWST will engage in an individualized, interactive process with the student to determine an appropriate reasonable accommodation.
SWST may request additional information necessary to evaluate the request and may consult with qualified professionals as appropriate.
Each request will be evaluated on a case-by-case basis.
5. Examples of Reasonable Accommodations
Depending on the circumstances, reasonable accommodations may include:

Additional testing time.

Testing in a reduced-distraction environment.
-
Accessible classroom seating.
-
Permission to use approved assistive technology.
-
Accessible electronic course materials when available.
-
Additional breaks for medical reasons.
-
Permission to bring approved medical devices into the classroom.

Modified communication methods when appropriate.
The availability of accommodations depends upon the specific circumstances and course requirements.
6. Accommodations That May Not Be Provided
SWST is not required to provide accommodations that would:

Fundamentally alter the nature of the training program.

Eliminate or reduce essential course requirements.
-
Compromise firearms safety or range safety standards.
-
Violate DPSST administrative rules or licensing standards.
-
Lower competency or qualification standards.
-
Pose a direct threat to the health or safety of the student or others.

Create an undue financial or administrative burden.
7. Firearms and Practical Skills Training
Certain SWST courses involve firearms handling, defensive tactics, live-fire exercises, or other practical skills where safety is essential.
Reasonable accommodations will be considered; however:

Students must safely manipulate and control firearms or other required equipment.

Students must comply with all range safety rules and instructor commands.
-
Accommodations will not excuse students from demonstrating required competencies necessary for successful course completion or DPSST qualification.
If an accommodation would prevent safe participation or fundamentally alter required performance standards, SWST may determine that the accommodation cannot be granted.
8. Examinations
When appropriate and supported by documentation, accommodations for written examinations may include:

Extended testing time.

Alternative testing locations.
-
Reader or scribe assistance where appropriate.

Other reasonable testing modifications.
Accommodations will not change the content of examinations or passing standards.
9. Confidentiality
Information regarding accommodation requests and supporting medical documentation will be maintained confidentially and shared only with individuals who have a legitimate need to know in order to implement the accommodation or comply with legal obligations.
10. Student Responsibilities
Students requesting accommodations are responsible for:

Making requests in a timely manner.

Providing requested supporting documentation.

Cooperating in the interactive accommodation process.

Complying with all course rules, safety requirements, and instructor directions.

Notifying SWST if an approved accommodation is no longer needed or requires modification.
11. Temporary Medical Conditions
Temporary impairments may qualify for accommodations depending on the nature, severity, and duration of the condition.
Requests related to temporary medical conditions will be evaluated individually.
12. Denial of Accommodation Requests
SWST reserves the right to deny accommodation requests when:

Insufficient information is provided.

The requested accommodation is not reasonable.

The accommodation would fundamentally alter the course.
-
The accommodation would compromise safety.
-
The accommodation would violate applicable law or DPSST requirements.
-
The accommodation would impose an undue hardship on SWST.
When feasible, SWST will attempt to identify an alternative reasonable accommodation.
13. Appeals
Students who believe their accommodation request has been improperly denied may submit a written request for reconsideration to SW Security Training LLC within ten (10) business days of receiving notice of the decision.
SWST will review the request and issue a final determination after considering any additional information provided.
14. Non-Retaliation
SWST prohibits retaliation against any individual who requests a reasonable accommodation or participates in the accommodation process in good faith.
